New OMMA Rules for Testing Labs take Effect Today
The challenge of varying test results among different laboratories has long been an issue in the marijuana industry across the country. In Oklahoma, this issue has been addressed through the passage of House Bill 4056 in 2022. This legislation tasked the Oklahoma Medical Marijuana Authority (OMMA) with collaborating with testing labs to enhance regulations and testing methods.
A dedicated committee, composed of seven lab directors, devoted over 90 hours in 15 meetings to develop comprehensive recommendations. Their efforts culminated in 120 pages of proposed equipment and testing standards. OMMA staff then spent more than 100 hours reviewing these recommendations, drafting proposed rules, and making revisions based on feedback.
During the public comment period for OMMA’s proposed permanent rules, 120 public comments were received. Each comment was meticulously reviewed and responded to by OMMA staff, resulting in adjustments to the testing requirements.
Today, June 1, 2024, new emergency rules come into effect, reflecting the committee’s recommendations. These rules aim to enhance the safety of medical cannabis and products for patients by amending testing requirements in Subchapter 8.
Summary of Key Changes:
• Implementation of round robin testing for statistical analysis to identify outliers
• Specific guidelines for instrumentation
• Detailed requirements for calibration and method validation
• Enhanced quality control measures
• Comprehensive personnel training requirements
