In recent years, Oklahoma has emerged as a significant player in the medical cannabis landscape in the United States. The state’s medical cannabis program is known for its permissiveness, attracting attention for its liberal policies and rapid growth. However, this growth has come with its share of challenges, leading to continuous evolution in the state’s cannabis laws and regulations.
As of November 14, the Oklahoma Medical Marijuana Authority (OMMA) has initiated a significant regulatory action. The authority is moving to revoke the licenses of 165 medical cannabis cultivation facilities. This decision stems from non-compliance with a critical requirement mandated by a bill passed last year.
The bill in question introduced a seemingly simple yet crucial regulation: the posting of signage on the property of medical cannabis cultivators. This signage is mandated to include the business name, phone number, address, and business license number. The law emphasizes transparency and easy identification of licensed growers, aiming to bring more structure to the rapidly expanding industry. The failure to comply with this signage requirement within 60 days post-license renewal is now leading to drastic consequences for many cultivators.
OMMA Executive Director Adria Berry highlighted the importance of compliance and regulation in the cannabis industry. Following the bill’s passage, OMMA inspectors were actively involved in identifying whether facilities adhered to the new regulations. Berry’s statement underscores the authority’s commitment to shaping a firmly-regulated cannabis market in Oklahoma.
In the past year, OMMA’s efforts have been expansive. Inspectors completed nearly 7,000 inspections and 4,600 operational status visits. These inspections are not just procedural but have led to significant enforcement actions:
Seizure of nearly five tons of illicit cannabis.
Embargo of approximately 3,000 pounds of cannabis and about 71,200 plants.
The closure of an entire dispensary.
Assistance in over 114 law enforcement operations, including 13 search warrants leading to arrests and 65 location visits to investigate complaints.
Recognizing the challenges of a permissive medical cannabis program, Oklahoma lawmakers have passed several bills in the last session. These legislative changes aim at curbing the diversion of medical cannabis products and enhancing state regulations. This move indicates a shift towards more stringent oversight, likely in response to the rapid growth and the complexities it has introduced.
